These terms and conditions govern your use of the Website and the purchase of digital house plans and related services offered by Adaptive House Plans (hereinafter referred to as “we,” “us,” or “our”). By accessing or using the Website, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms and conditions, please refrain from using the Website.
1. Purchase of Digital Products
1.1 House Plans: Our website offers digital house plans in PDF format for purchase. These house plans are delivered electronically and do not include physical products. By purchasing a digital house plan, you acknowledge that no physical product will be shipped to you.
1.2 Architectural Customization Services: In addition to digital house plans, we offer architectural customization services. These services involve modifying existing house plans according to your specific requirements. The deliverables for architectural customization services are digital files, such as revised PDFs or CAD files, which will be delivered electronically.
2. Exchange and Return Policy
2.1 Digital House Plans: Due to the nature of our digital products, and the ability for them to be easily copied or reproduced, we cannot be assured of fairness and, as such do not offer returns or refunds. Adaptive House Plans will exchange your first order for another blueprint or house plan package of equal or lesser value within 30 days of your original date of purchase.
2.2 Architectural Customization Services: Once architectural customization services have commenced, no exchanges or returns are possible. It is your responsibility to provide accurate and detailed information during the customization process to ensure the desired modifications are accurately implemented.
3. Copyright Protection
3.1 All house plans, designs, images, and content on the Website are protected by copyright laws and are the intellectual property of Adaptive House Plans, its affiliates, or licensors. Unauthorized reproduction, distribution, or use of any copyrighted material from the Website is strictly prohibited.
3.2 By purchasing a digital house plan or availing yourself of our architectural customization services, you are granted a non-exclusive license to use the purchased digital files for the purpose of constructing one (1) physical structure. This license does not permit you to reproduce, distribute, modify, or sell the files, or use them to construct multiple structures, without obtaining written consent from Adaptive House Plans.
4. Code Compliance
4.1 Our digital house plans are designed to meet generally accepted architectural standards. However, it is your responsibility to ensure that the house plans, including any modifications made through our architectural customization services, comply with local building codes, regulations, and restrictions in your specific area.
4.2 Adaptive House Plans cannot guarantee that our house plans, including any customized versions, will comply with all local building codes or obtain specific permits for your project. Due to varied geography and climate throughout the United States and Canada, each province, state, city, county, and local municipality often has its own building codes and regulations. Modifying your blueprints to meet local requirements and varying provincial building codes may be necessary.
4.3 Each of our blueprints was designed and modelled to meet or exceed the British Columbia Building Code (BCBC) 2020 requirements, The Canadian National Building Code including the latest revisions from December 2018 relating to section 9.36. – updates to effective insulation requirements. For our American customers, an American variation designed to meet the International Building Code.
5. Pricing Guarantee
5.1 We offer a pricing guarantee for a period of 30 days from the date of purchase. If you have purchased a digital house plan or availed yourself of our architectural customization services, and the price for the same product or service is reduced within 30 days, we will refund you the difference upon request.
5.2 To request a pricing guarantee refund, please contact our customer support within 30 days of your purchase. We may require proof of the reduced price, such as a link to a promotional offer or advertisement.
5.3 The pricing guarantee applies only to the exact product or service you have purchased and does not apply to promotional offers, bundle deals, or discounts available to new customers.
6. Disclaimer of Damages
6.1 The Website and all its content, including digital house plans and architectural customization services, are provided on an “as is” and “as available” basis. We make no warranties or representations, express or implied, regarding the accuracy, completeness, or reliability of the Website, its content, or any services offered.
6.2 To the fullest extent permitted by law, Adaptive House Plans disclaims any liability for any direct, indirect, incidental, special, or consequential damages, including but not limited to damages for loss of profits, revenue, data, or use, incurred by you or any third party, arising from the use or inability to use the Website or any purchased house plans or services.
